Night work reform: flexibility comes with new conditions
Night work in Belgium has long been restricted to specific exceptions. From June, that flips: night work becomes permitted in principle. At the same time, the definition tightens. The current reference window of 8 pm to 6 am shifts to 11 pm to 6 am. Work between 8 pm and 11 pm will no longer automatically qualify as night work.
Allowances continue under stricter conditions
Night-time premiums are not abolished. However, benefits that currently apply from 8 pm will only apply from 11 pm onwards. For organisations that have long remunerated evening work as night work, existing payroll practices may no longer align with the new legal reality.
The tax impact is real
The withholding tax exemption for night work is tied directly to the time window, and that window is moving. Work that qualifies today may not qualify from June. Systems that are not updated in time risk both missed savings and compliance errors.
Three questions to ask now
- Do existing contracts or CBAs still attach night work allowances to the 8 pm–11 pm slot?
- Are payroll and time-recording systems still configured around the old 8 pm threshold?
- Has the withholding tax exemption been reviewed against the new rules?
An opportunity, not just a constraint
The 1 June deadline is a natural prompt to reassess payroll structures, incentive policies, and tax optimisation, and for many organisations, the new framework will open up genuine room to streamline.
