Despite the fact that the Brussels Region has been entrusted with the management of property withholding tax, which is supposed to clarify regional tax competences, the capital&#8217;s landscape continues to give rise to uncertainty and controversy, particularly around <strong>double taxation<\/strong>. <\/p>\n<p>On February 26, 2025, the Brussels Court of Appeal handed down a landmark ruling in a dispute concerning the regional tax on areas not used for residential purposes (&#8220;TRB&#8221;) provided for in the ordinance of July 23, 1992. As this ruling may affect many taxpayers, we are here to provide you with the most essential updates. <!-- notionvc: bcb7b633-5f52-49d9-9acf-4c7b93ca0efb --><\/p>\n<p><!-- notionvc: 56ca3d31-6b60-4660-acba-488ad5a483dd --><\/p>\n<h2 class=\"\" data-start=\"525\" data-end=\"601\"><span class=\"notion-enable-hover\" data-token-index=\"0\">The taxpayer&#8217;s argument<\/span><!-- notionvc: 2608bb8d-f6f5-4040-9dbf-665ea6d56e6c --><\/h2>\n<p class=\"x_MsoNormal\">The taxpayer contested the TRB on the grounds that it affected a matter already taxed by the federal government, through corporate income tax and withholding tax on real estate. He thus denounced a violation of the <span class=\"notion-enable-hover\" data-token-index=\"1\">non bis in idem<\/span> principle, according to which the same matter cannot be taxed twice. <!-- notionvc: fd216f4c-f1d7-44d5-92bf-1a80c8341ce5 --><br \/>\n<!-- notionvc: 6affbc6c-81e1-4a1e-a6d8-9a6ca7b7de88 --><\/p>\n<h2 class=\"\" data-start=\"1089\" data-end=\"1132\"><span class=\"notion-enable-hover\" data-token-index=\"0\">The Court of Appeal&#8217;s response<\/span><!-- notionvc: c41e170a-e5bd-4908-8420-790bfcf1e13b --><\/h2>\n<ul>\n<li><strong>With regard to corporate income tax<\/strong>, the Court ruled that there is no double taxation: the taxable matter is different. Corporate income tax is based on the income from the property, whereas TRB is based on the holding of a real right or simple possession. <\/li>\n<li>On <strong>the other hand, when it comes to withholding tax on real estate<\/strong>, the Court recognizes a risk of overlap. The two taxes share the same taxable subject (ownership of a real right) and are calculated on the basis of cadastral income. However, the withholding tax on real estate is no longer truly a tax on income, since it is due independently of any income actually received.  <\/li>\n<\/ul>\n<p>The Court of Appeal therefore decided to refer a <span class=\"notion-enable-hover\" data-token-index=\"1\">question to the Constitutional Court for a preliminary ruling<\/span>, in order to determine whether the TRB violates the rules governing the division of fiscal powers, calling into question the coexistence of this tax with the withholding tax on real estate.<!-- notionvc: a3872a93-9bd2-432d-a920-2f0f368a2c6f --><br \/>\n<!--
